DO YOU REMEMBER …

The day you proudly raised your right hand, with your left on the Bible and said:

“I do solemnly swear that I will defend the Constitutions of the United States and of the State of _______ from all enemies, be they foreign or domestic, and will faithfully perform the duties of a police officer to the best of my ability, so help me God.”

Do you recall how you felt that day?  Do you remember the pride you felt?  Was there anything that could have kept you from protecting the people of your community?

That was probably a moment that you will remember as long as you live.

 

DO YOU REMEMBER …

Studying the following list of the Ten Amendments?  More importantly, do you remember living with them?

  1. Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
  1. The citizens have the unalienable right to keep and bear arms.
  1. No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner.
  1. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
  1. There will be no double jeopardy or self-incrimination, and the citizens are protected with due process and the takings clause.
  1. Citizens have the Right to a speedy and public trial, by an impartial jury of the State and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor; and to have the assistance of counsel for his defense.
  1. The right of trial by jury shall be preserved.
  1. No cruel and unusual punishments inflicted.
  1. The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.
  1. The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

 

I WAS ONLY FOLLOWING ORDERS …

That excuse doesn’t work. Period.

While multiple documented uses of “I was just following orders” defense have existed prior, the “superior orders” plea is most commonly associated with the 1945-1946 Nuremberg trials, the military tribunals that followed World War II. The London Charter of the International Military Tribunal was issued which stated that the “superior orders” is not a valid defense against charges of war crimes.

It didn’t work there and it won’t work in American Criminal or Civil Courts, either.

If you do something under the color of law that you know – in your heart of hearts – to be wrong, your ass is on the hook, buddy. Remember that.



 

BOZO RANTS FROM THE LOONEY BIN

Following is a partial list of what some of the Executive Orders issued by state Governors across the nation. (Please note: I didn’t duplicate any of the moronic memes although many governors did play follow the idiot … I mean leader.)

New York.  If you live there, you will find a curfew of 2200 hours on bars, restaurants, gyms which also have new restrictions on capacity. IN YOUR HOME, you may not have more than ten people, unless they are all residents. As your Mother used to say, “If you don’t behave, they threaten to tighten the screws even more.”

Oregon. These folks are also being denied the right to workout / exercise, there will be NO indoor restaurant dining and there are severe capacity restrictions on retailers, grocery stores and (of course) churches.

Chicago.  The mayor has decreed that her minions must stay home. The only exceptions will be for work, school and essential needs. No one may have guests in their home, travel should be avoided and … oh, by the way: cancel Thanksgiving. There is a severe punishable limit on private gatherings along with a curfew from 2300 – 0600 hours, daily. All of these rules apply to everyone, except … if you are the mayor and deem getting your hair fixed supersedes all of those rules put upon your subjects.

Philadelphia. Just when you though the Executive Orders couldn’t get any more ridiculous, the wizardly mayor there decreed that there shall be NO singing and (of course) NO loud music.

Obviously, these rules apply only to the peons. The Governor of California was just spotted at the posh French Laundry restaurant with a large crowd around a round table. Masks? You ask?  Certainly, you jest.

We cannot dismiss our recollection of Chicago’s Mayor who just attended a large Democratic party celebrating the election. Fun was had by all; masks were worn by none.

And, who can forget Nancy Pelosi’s emergency need for a fresh hair-do? Everything was on the up-and-up, though. Masks everywhere … except on anyone’s face. Oh.

REMEMBER THIS: According to the Constitution that we all swore to defend, it says that laws are considered and adopted by an elected legislative body. They then become law when the executive (President, Governor, etc.) sign the proposal thus making it the law of the land.

Executive orders?

They look real formal and stuff. Maybe even written in fancy print. But …

THEY ARE NOT LAWS.  PERIOD.

The people who issued them are executives. They are NOT gods – by any stretch of the word.

 

WHAT CAN YOU DO NOW?

 If your agency has a union, now’s the time for its leaders to stand up. Remind your community that you took an oath to defend the Constitution, not some hastily drawn, tyrannical order that isn’t worth the paper it’s written on.

Get the union counsel to advise the members on the best course of action.

If you don’t have a union, it may be best to seek a legal opinion on your own or maybe collectively with other guys from your shift.

Aside from the lawyers …

Read the Constitution, again. You already know a few things about it:

Government has only those authorities given to it. Everything else belongs to the people.

Study the Bill of Rights.

Is there any place where you see that the government can:

  • Order legal businesses to close?
  • Tell residents how many guests they can have in their homes?
  • Control whether or not you can workout, go out to dinner or take in a movie?
  • Tell citizens that they may not go to church to worship and sing with others of their faith?
  • Forbid citizens the right to celebrate Thanksgiving?

“Oh, but this is an emergency,” they will say.

Alright. The correct response is clear:  “Show me in the Constitution where it defines the word, emergency. Then, show me where anyone in the government has the unilateral authority to suspend my fundamental rights for an indefinite period of time.

Those things aren’t in our founding documents. They know it and so do we.

Ask yourself this –

How would the Court treat me if I randomly entered citizens’ homes to search for anything which meets my fancy?

What would the Court do if I wantonly murdered a few people while on duty tonight all in the name of target practice?

Maybe if it is something as easy as just putting a person or two in jail with no charges and no probable cause?

If I cannot violate those cannons of our Constitution.  Why should I believe that I can violate others?

If you think you can get off the hook by saying, “I was just following orders,” you can wipe your ass with that excuse because that’s all it’s worth.

 

 “Above all, it’s about going home at the end of the shift … “
